Portuguese Citizenhip - Sephardic Jews

The Department of Immigration Law, has played a relevant role, particularly in obtaining Nationality to descendants of Sephardic Jews, since Decree-Law no. 30-A / 2015, dated 27-02, has now entered into force, currently possessing the necessary know-how, that allows to provide all the services inherent, at all stages of the process.


Who has the right to Portuguese Nationality by Sephardic descent:

General requirements:

The general requirements for naturalization, are set forth in Article 6.º n.1, (a) (d) and (e) of the Nationality Law, ie:

- Under age or emancipated under Portuguese Law;

- Not have been convicted, with res judicata, for the practice of an offense punishable by a term of imprisonment not exceeding 3 years, according to Portuguese Law.

- Do not constitute a danger or threat to national security or defense, for their involvement in activities related to the practice of terrorism, under the terms of the respective Law.

Proof of descent to a Sephardic community of Portuguese origin:

The proof of descent of Portuguese Sephardic Jews can be made through the tradition of belonging to a Sephardic community of Portuguese origin, based on proven objective requirements of connection to Portugal, namely surnames, family language, direct or collateral descent.

It establishes the provisions of Article 24-A n.º 3 (c) of the Portuguese Nationality Regulation, that the applicant must present a certificate of Jewish community with the status of religious legal person established in Portugal, in accordance with the Law, attesting to the tradition of belonging to a Sephardic community of Portuguese origin, embodied in the surname of the applicant, family language, genealogy and family memory.

Therefore, the law favors obtaining a certificate of Jewish community based in Portugal attesting to the tradition of belonging to a Sephardic community of Portuguese origin. In order to obtain the certificate, it is necessary to present evidence proving such a tradition of belonging, which may take various forms, including testimonial evidence.

In the absence of a certificate, other means of proof may be accepted, in particular the following:

- Document issued by the Jewish community to which the applicant belongs, attesting to the applicant\'s use of Portuguese expressions in Jewish rites, or as a language spoken by him in the middle of that community, of the Ladino.

- Documentary records, such as records of Jewish synagogues and cemeteries, as well as residence permits, property titles, wills and other documents evidencing the applicant\'s family connection, by direct descent or family relationship in the collateral line of the common parent, from a Sephardic community of Portuguese origin.

In case of doubt as to the authenticity of the content of the documents identified above, issued abroad, the Ministry of Justice may request the Jewish Community with the status of a religious legal person, based in Portugal, to give an opinion on such evidence.

Stages of the Naturalization Process:

Our services, include the preliminary procedure for the analysis and instruction of documents proving the connection to a Sephardic community of Portuguese origin, and subsequent administrative procedure for the acquisition of Portuguese Nationality, which is divided into two phases:

Phase 1:

Legal advice, in the scope of the investigation of the processes, with historical and administrative documentation.

Although it is possible to instruct the naturalization procedure, without the certificate proving the Jewish Sephardic origin, such a document is of vital importance in order for such a procedure to be as fast as possible, and for its outcome to be as intended (approval of the application for naturalization).

Phase 2:

    Documents required for order processing:

1. A request addressed to the Minister of Justice, written in Portuguese, including the full name, date of birth, marital status, nationality, place of birth, and nature of the request and other circumstances that the interested party considers relevant, current Job and current residence, as well as the indication of the countries where he / she has previously resided; the mention of the number, date and issued of the title or residence permit, passport or equivalent identification document of the person concerned, as well as of the Lawyer; the indication and demonstration of the circumstances that determine the tradition of belonging to a Sephardic community of Portuguese origin, namely family names, family language, direct descendants or collateral of a common parent from the Sephardic community of Portuguese origin.

2. Full birth certificate, duly legalized and accompanied by a translation, if written in a foreign language. (If the birth certificate appears in the Portuguese civil registry, this certificate is obtained by the services.
 
3. Certificate of criminal record, of the country of place of birth and of the nationality, as well as of the countries where the person concerned has had and is resident after the age of 16, for more than 3 months, duly legalized and accompanied by a translation, if written in a foreign language. (The interested party is exempted from presenting the Portuguese certificate of criminal record, which is officially obtained by the services).

4. Certified photocopy of the first page of the passport.

5. Certificate issued by a Jewish religious association, accredited in Portugal, proving that the interested party belongs to a Portuguese Sephardic community.

6. Power of Attorney

In special cases, the Minister of Justice may, on a reasoned request by the interested party, dispense with any document that must be made in the application for naturalization, provided that there is no doubt as to the verification of the requirements that the document was intended to prove.

Government costs: 250,00EUR (the non payment of the IRN costs, determines the preliminary rejection or the execution of the account).

The application may, without certain situations, be dismissed at the outset. In that case, the person concerned shall be notified of the reasons for the refusal to give a decision within 20 days. If the application is dismissed at the outset and the reasons for its rejection are maintained, no guarantee shall be reimbursed.
